Our Commitment to Privacy

Appatecht, LLC (“Company,” “we” or “us” or “our”) respects the privacy of the users (“user” or “you”) of the GOOD CALL BAD CALL application (the “App”). We’ve developed this Privacy Policy that explains our online information practices and the choices you can make about the way your information is collected and used by the App which includes any online or mobile websites, applications or digital services provided by the GOOD CALL BAD CALL mobile application (a “Service,” or collectively the “Services”).

We note that California law requires us to provide certain information about how we collect and use the personal information of California residents and to grant those California residents certain rights with respect to their data.If you are a California resident, please see the “California and CCPA Privacy Rights and Disclosures” section of this Policy for these disclosures and a description of your privacy rights, including a right to access, delete, or opt out of the sale of your personal information.

By using the App, you agree to the collection, disclosure, storage, and use of your information as outlined in this Privacy Policy. If you do not want us to collect, store, use, or share your information in the ways described in this Privacy Policy, you should not utilize the App. We may amend the Privacy Policy from time to time, and we encourage you to consult the Privacy Policy regularly for changes.

Users in certain jurisdictions have a right to access personal information held about themselves. Your right of access can be exercised in accordance with applicable law.

The Information We Collect and How We Collect It

We receive both information that is directly provided to us, such as personal information you provide when you visit the Services, and information that is passively or automatically collected from you, such as anonymous information collected from your browser or device. In this Privacy Policy, we refer to all of this as the "Information".

We do not sell or rent personally-identifying information collected during your use of our App without your permission. The information we collect will be utilized to communicate with you about the App and about features and promotions associated with the App. We also use information to statistically analyze site usage, to improve our content and product offerings and to customize our site's content, layout, and services. We do not share your personal information with third parties for their direct marketing purposes unless you affirmatively agree to such disclosure, typically by “opting in” to receive information from a third party that is participating in a sweepstakes or promotion on the App. We do not share information with any third party (other than our service providers) on a continual basis.

User Name and Password:At the time you download the App, you are asked to provide a display name, email address, and password.Your display name does not have to be personally identifiable. For purposes of security and privacy, your password should not include your name or contain other information which others might identify with you.

Location Information.We may collect and store information that you voluntarily provide to us through the App to enable certain features, personalize your use of the App, answer questions, and otherwise improve services and features of the App. If you are using a mobile device, we may request that you share your precise (GPS level) geo-location information with us so we can customize your experience with the App and whenever we work with a third-party mobile advertising platform. If you agree to such collection, in most cases, you will be able to turn off such data collection at any time by accessing the privacy settings of your mobile device and/or through the settings in the applicable mobile application.

Other Information. When you use the App we may automatically collect and store certain information in server logs including but, not limited to, internet protocol addresses, device model and make information.We may use this information to personalize the services offered by us, to distinguish your device from others, prevent fraud, provide technical support, respond to your needs, and/or otherwise to access and improve the functionality, performance, and desirability of the App. We may also gather general statistical information about our App and patterns of its users, points earned by location or user type, rewards granted and redeemed. We use this data to improve and customize your experience with the App.

Information Collected by Third Party Platforms.You also can engage with the App through social media services or other third-party platforms, such as Facebook, or other third-party social media plug-ins, integrations and applications. When you engage with our content on or through social media services or other third-party platforms, plug-ins, integrations or applications, you may allow us to have access to certain Information in your profile. This may include your name, e-mail address, photo, gender, birthday, location, an ID associated with the applicable third-party platform or social media account user files, like photos and videos, your list of friends or connections, people you follow and/or who follow you, or your posts or "likes." For a description on how social media services and other third-party platforms, plug-ins, integrations or applications handle your information, please refer to their respective privacy policies and terms of use, which may permit you to modify your privacy settings.

Cookies and Automated Information Collection. We, and service providers acting on our behalf, may store and use tracking technologies such as "cookies" to collect information. A cookie is a small data file that is transferred to your mobile device for record-keeping purposes. The App may send cookies to a mobile device when a user accesses or views the Service. Information contained in a cookie may be linked to personal information for purposes such as improving the quality of the App, tailoring recommendations to your interests, or making the App easier to use.

We may combine any of the Information we collect, for any of the above purposes, and may sometimes enhance the Information with other information that we obtain from third party sources. If you register and create a profile with our App, the screen name you select as well as other content you submit to your profile will be displayed on the App, is searchable, can be found by third parties and may be reused and redistributed by us in our sole discretion.

Third party advertisers on the App may also use, place or read cookies or other technologies as described below on your browser, and those practices are subject to their own policies. Cookies can be disabled at any time by changing your browser’s options to stop accepting cookies, to prompt you before accepting a cookie from the websites you visit or limit the type of cookies you allow. If you do not accept cookies, however, you may not be able to use all features, portions, or functionalities of the App.

We and our service providers may also employ other technologies including (i) web beacons, which allow us to know if a certain page was visited or whether an e-mail was opened; (ii) tracking pixels, which allow us or our advertising partners to advertise more efficiently and effectively by excluding our current users from certain promotional messages, identifying the source of a new installation or delivering ads to you on other websites; and (iii) local shared objects known also as flash cookies, which help us to reduce fraud, remember your in-app preferences and speed up load times. We and our service providers use these log files, tags, and tracking technologies to collect and analyze certain kinds of technical information, including, but not limited to: type of device you are using, your mobile device’s identifiers, your browser type, platform type, domain names, landing pages, and the number of clicks on a page or feature. In some cases, we will connect this Information to your social network ID or username in the App.

How We Use Your Information

The main use of the Information we collect and store is to provide a better experience for you in the App. Such uses include, but are not limited to, operating, improving, and optimizing the App and the user experience; identifying and suggesting connections with other users of the App and personalizing the Services for your use; to provide technical support and respond to user inquiries; to manage and deliver contextual and behavioral advertising; and to protect our rights and property in connection with the Services.

Security

We employ reasonable and current security methods to prevent unauthorized access, maintain data accuracy, and ensure correct use of Information. We have put in place physical, electronic, and managerial procedures designed to help prevent unauthorized access, to maintain data security, and to use correctly the Information we collect online. These safeguards vary based on the sensitivity of the Information that we collect and store.

Although we take appropriate measures to safeguard against unauthorized disclosures of Information, we cannot assure you that Information will never be disclosed, altered or destroyed in a manner that is inconsistent with this Privacy Policy.

Your use of the App is password-protected. We recommend that you do not divulge your password to anyone. Our personnel will never ask you for your password in an unsolicited phone call or in an unsolicited e-mail.

How We Share Your Information

We may disclose or publish aggregated and analytical information (information about you and other users collectively that is not intended to specifically identify you) and other non-personal information about our users for industry analysis, demographic profiling, marketing, analytics, advertising, and other business purposes. In addition, we may share your information (which may contain personal information) with third parties or allow third parties to collect this information from our Services in the following circumstances:

  1. Friends and Other App Users

If you sign up for the App through a social network, your social network friends will see your name, profile photo, and your teams. In the App itself, other users, regardless of whether they are your social network friends or not, may be able to see descriptions of your activity within the App, communicate with you within our Services, and view your profile, which may include your name or a user name and your profile photo.

  1. Third-Party Advertising

We may have advertising on the App so we can continue to offer our Services for free. When advertisers or ad networks place ads in our App, they may collect, or we may share the following types of information from within our Services: performance data; aggregated, non-personally identifying information about you and other users; certain technical information, social network ID, contextual data about your App usage.

Advertisers or ad networks may collect this information through the use of tracking technologies like browser cookies and web beacons, and they may use a single tracking technology or multiple tracking technologies at the same time.

After clicking on a third-party advertisement, you may no longer be on a site hosted by Appatecht, LLC or the social network through which you are accessing the App.

If you do not want to receive tailored in-application advertisements from third parties, please submit “Disable Direct Marketing” to support@appatecht.com.

  1. Third Party Service Providers

We use third-party companies to perform certain services to facilitate the Services. We contractually require these third-party service providers to maintain the confidentiality of the information we share with them, and we contractually require them to not use your information for anything other than to provide services on our behalf.

  1. Sale or Merger

In the event a portion or all of our business is sold or merged with another entity, your personal information may be transferred to the other entity as a part of the business transfer or merger. We will make reasonable efforts to let you know of the business transition before transferring your personal information.

How You Can Access, Update, and Manage Your Information

If you no longer want us to make active use of your personal information, you can submit a request to support@appatecht.com. Following such request, a verification email will be sent to you to authenticate your identity and to ask for your confirmation of the request. Your account can also be deleted or deactivated, but doing so will result in your not being able to access the App.

We may ask you to provide additional information for identity verification purposes, or to verify that you are in possession of an applicable email account.

If you have signed up to receive our e-mails and prefer not to receive marketing information from this Service, follow the "unsubscribe" instructions provided on any marketing e-mail you receive from this Service. If you have signed up to receive text messages from us and no longer wish to receive such messages, you may follow the instructions to stop the delivery of such messages, which may include by replying "STOP" to the received text message.

Third Party Practices

The Privacy Policy of an advertiser or promotional service appearing at our site may differ from ours. We encourage you to read that policy before responding to the offer.

Changes to Our Policy

We may change the Privacy Policy from time to time. Should we make any changes to this Privacy Policy, we will revise the “Effective Date” promptly. Should we make any material changes to this Privacy Policy, we will provide notice thereof by prominently displaying a notice or pop-up upon logging in to the App stating that the Privacy Policy will be changed, identifying how to find out about the changes, and when the changes will go into effect. Your continued use of the App following the posting of changes constitutes your acceptance of such changes.

California and CCPA Privacy Rights and Disclosures

This section addresses legal obligations and rights laid out in the California Consumer Privacy Act, or “CCPA.” These obligations and rights apply to businesses doing business in California, to California residents, and to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with California consumers or households (“California Information”). The information contained in this section applies to California Information collected and used by Appatecht, LLC (for the purposes of this section, “we” or “us”). If you are a California resident and would like to learn more about this information, please review the following sections.

This section provides the information California residents need to exercise their rights over their California Information.

CALIFORNIA INFORMATION WE COLLECTED

In the past 12 months, we collected the following categories of California Information:

• Unique and online identifiers – email address, IP address, device IDs, cookie identifiers, or other similar identifiers

• Internet, gaming or other electronic network activity information – such as browsing history, search history, and information regarding an individual’s interaction with an internet website, application, or advertisement

• Location information – (e.g. if you access our App on your mobile device we may collect Information about your device’s precise location.)

• In game or online viewing activities (e.g., videos viewed, pages viewed)

• Inferences drawn from California Information, such as individual preferences, characteristics, behaviors.

In the last 12 months, we collected these categories of California Information for the following purposes:

• Debugging errors in systems

• Marketing and advertising

• Internal research, analytics and development – e.g., user-preference analytics

• Developing, maintaining, provisioning or upgrading networks, products, services, or devices.

In the last 12 months, we obtained California Information from a variety of sources, including:

• Directly from you, including technical and usage information when you use our App

• Linked sites, such as Social Media Sites, and third-party platforms

CALIFORNIA INFORMATION WE SHARED

In the past 12 months, we shared the following categories of California Information for operational purposes with providers who provide services for us,

• Unique and online identifiers – IP address, device IDs, cookie identifiers, or other similar identifiers

• Location information – (e.g. if you access our App on your mobile device we may collect Information about your device’s precise location.)

The California Consumer Privacy Act defines ‘sale’ very broadly. It includes the sharing of California Information in exchange for anything of value. According to this broad definition, we do not sell any categories of California Information.

2. Your California Privacy Rights to Request Disclosure of Information We Collect and Share about You

If you are a California resident, the CCPA permits you to request information about our practices related to the disclosure of your personal information by Appatech, LLC to certain third parties for their direct marketing purposes. You may be able to opt-out of our sharing of your personal information with unaffiliated third parties for the third parties’ direct marketing purposes in certain circumstances. Please send your request (along with your full name, email address, postal address, and the subject line labeled “Your California Privacy Rights”) by email at support@appatecht.com.

In addition, if you are a California resident, the CCPA grants you the right to request that we disclose certain information about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

• The categories and specific pieces of your California Information that we’ve collected

• The categories of sources from which we collected California Information

• The business or commercial purposes for which we collected or sold California Information

• The categories of third parties with which we shared California Information.

You can submit a request to us for the following additional information:

• The categories of third parties to which we’ve sold California Information, and the category or categories of California Information sold to each

• The categories of California Information that we’ve shared with service providers who provide services for us

3. Your Right to Request the Deletion of California Information

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.

Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

Debug products to identify and repair errors that impair existing intended functionality.

Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.

Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

Comply with a legal obligation.

Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

4. Exercising Your Rights to Access, Data Portability, and Deletion

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

Only you, or someone legally authorized to act on your bealf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

• Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include: display name and password, etc.

• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

We will endeavor to respond to a verifiable consumer request within forty-five(45) days of its receipt. If we require more time (up to 90 day), we will inform you of the reason and extension period in writing.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Once we receive and process your request, we will not sell your California Information unless you later allow us to do so.

5. Consumers Under 16 Years Old

CCPA has specific rules regarding the use of California Information from consumers under 16 years of age. In particular, consistent with the CCPA, if we have the California Information of a consumer under the age of 16, we will not sell the information unless we receive affirmative permission to do so. If the consumer is between the ages of 13 and 16 years of age, the consumer may provide that permission; if the consumer is under the age of 13, the consumer’s parent or guardian must provide the permission. Consumers who opt-in to personal information sales may opt-out of future sales at any time.

You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.

6. Our Support for the Exercise of Your Data Rights

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

• Deny you goods or services

• Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

• Provide you a different level of quality of goods or services.

• Suggest that you may receive a different price rate for goods or services or a different level of quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA=permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.
